Terms & Conditions – Quirkies

Welcome to quirkies.ca, a website operated by FoodFund Inc. (“Quirkies”, “we”, “our”, or “us”), based in Ontario, Canada. These Terms & Conditions (“Terms”) govern your access to and use of our website, products, and services, including our subscription-based delivery of cold-pressed juices.

By placing an order, subscribing, or using our services, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

 

1. Subscription Model

Quirkies operates on a weekly subscription-only basis. When you subscribe, you agree to receive recurring juice deliveries unless and until you skip, pause, or cancel.

  • No commitments: You can skip a delivery, pause your subscription, or cancel anytime.
  • Cut-off time: Changes must be made by Tuesday at 11:55 PM ET / 8:55 PM PT for the upcoming week’s delivery.
  • If you miss this deadline, the upcoming order will be processed and delivered as scheduled.

 

2. Product Information

We make every effort to describe and display our juices accurately. However:

  • Flavour availability may vary due to sourcing of rescued produce.
  • Bottle size is 300ml unless otherwise stated.
  • Ingredients may change slightly from batch to batch depending on supply.
  • Most, if not all, juices are cold-pressed and HPP-treated (not pasteurized).

We do not guarantee the availability of specific flavours, although we aim to maintain consistency and communicate changes transparently.

 

3. Pricing and Payment

All prices are listed in Canadian Dollars (CAD) and are subject to change without notice. We may offer promotional discounts, which are subject to expiration or modification.

  • Payments are processed securely via our third-party provider (e.g. Shopify).
  • By subscribing, you authorize us to charge your chosen payment method on a recurring basis until cancellation.
  • We are not responsible for overdraft fees or other charges resulting from automatic billing.

 

4. Shipping & Delivery

  • We currently deliver to select regions in Ontario, Alberta, British Columbia, and Quebec. Use our postal code checker (https://www.oddbunch.ca/pages/delivery-areas) to confirm delivery availability.
  • Deliveries are made once per week, typically between Wednesday–Saturday, depending on your region.
  • Our juices are shipped in recyclable boxes, uninsulated, and must be refrigerated immediately upon receipt.
  • We are not responsible for orders left unrefrigerated post-delivery.

 

5. Refunds, Replacements & Cancellations

Due to the perishable nature of our product, we do not accept returns. However:

  • If your order arrives damaged, spoiled, or incorrect, contact help@quirkies.ca within 24 hours of delivery. Include photos for faster resolution.
  • We reserve the right to issue refunds, credits, or replacement product at our discretion.
  • To cancel, pause, or skip a subscription, you must log into your account and do so before the weekly cut-off (Tuesday at 11:55 PM ET / 8:55 PM PT).

 

6. Use of Site and Services

You agree not to:

  • Use the site for any unlawful or prohibited purpose.
  • Access our systems or interfere with operations in any way.
  • Copy, reproduce, or distribute site content without written permission.

All content, branding, trademarks, and designs are property of FoodFund Inc. and protected by applicable copyright and trademark laws.

 

7. Wholesale, Bulk, or Corporate Orders

For bulk purchases, wholesale inquiries, or corporate gifting, reach out to help@quirkies.ca. These orders may be subject to separate pricing, shipping timelines, and terms.

 

8. Account Responsibility

You are responsible for maintaining the confidentiality of your account and password, and for all activities under your account. Notify us immediately of any unauthorized access or security breach.

 

9. Limitation of Liability

To the fullest extent permitted by law, Quirkies shall not be liable for:

  • Any indirect, incidental, special, or consequential damages;
  • Losses from misuse or improper storage of products post-delivery;
  • Interruptions to service due to events outside our control (e.g. weather, carrier delays, or supply disruptions).

Our maximum liability to you shall not exceed the total amount paid by you in the 3 months preceding the event giving rise to the claim.

 

10. Indemnification

You agree to indemnify and hold harmless Odd Bunch Inc., its employees, contractors, and affiliates from any claim, loss, or liability arising from your use of the website or services, your violation of these Terms, or any misuse of our products.

 

11. Governing Law

These Terms shall be governed by the laws of the Province of Ontario and applicable federal laws of Canada. Any disputes shall be subject to the exclusive jurisdiction of the courts in Ontario.

 

12. Changes to Terms

We may update these Terms from time to time. Continued use of the website or services after changes indicates your acceptance of the revised Terms. The date at the top will reflect the latest version.
